Community Land Management Plan for Second Valley Springs

The Second Valley Springs were previously located on a Council road reserve, Council has undertaken the road closure process and following completion of that process a new Certificate of Title Volume 6238 Folio 707 was issued on 10 June 2020 in the name of The District Council of Yankalilla.

The newly created parcel is classified as community land and in accordance with Section 196(1) of the Local Government Act, a Council must prepare and adopt a management plan if the community land “has been, or is to be, specifically modified or adapted for the benefit or enjoyment of the community”.

The land has been modified due to the existence of the historic concrete pools which were historically used by the local community to access fresh water, however due to the sensitive environment that the springs are located in, they will not be open for the “enjoyment of the community”.

In accordance with Section 196(7) of the Local Government Act 1999, Council must adopt a management plan for community land as soon as practicable after the Council has acquired the title to the land.

A Council can only adopt a new management plan after public consultation has been undertaken in accordance with Section 197 of the Local Government Act 1999.

The proposed Community Land Management Plan outlines the purpose the land is being held for is the ongoing protection and monitoring of the freshwater springs.

Following the community engagement process, feedback received will be analysed and a revised CLMP will be presented to Council for consideration for adoption in early 2021. Once adopted, Council must continue to manage the land in accordance with the Management Plan.
